Abstract: Argues that, contrary to received docctrine, the process of secession and formation of new states is subject to international law. Develops a normative framework for the steering of such secessionist processes on the basis of a general theory of principles in international law, their interpretation and ways of legal concretisation. Applies this framework to the context of the secession of Kosovo from Serbia. Draws constructive implications from the framework for international actors, namely the UN Security Council but also the International Court of Justice and the UN General Assembly.
